As Expert Determination is a confidential process, we require your representative to sign this Confidentiality Agreement.

Your representative will be the “Lead Claimant”, meaning they will be the party that we communicate with.

In that case, we will communicate directly with you.

As the Claimant, you must prove to the Expert that both elements are 'more likely than not to exist'.

As the Claimant, you must pay the Expert’s Fee specified on the NZDRC Website dnc@nzdrc.co.nz, currently NZ$2,300 ($2,000.00 plus GST) within 2 working days of submitting this form, before your Expert Determination can commence.

Once your Claim is received, we aim to assess and communicate whether your Expert Determination Claim is accepted or declined within five working days. If accepted, once the Expert's fee is paid, we will send your claim to the Respondent and request their response within 10 working days.

Once we receive the Respondent’s response, or after the response period has expired without a response, we aim to appoint an Expert within 3 working days. We will notify all parties once the appointment has been made.

In submitting this Expert Determination Claim Form, the Claimant confirms that they:

1. require the Claim to be referred to Expert Determination under the Scheme;
2. submit to the exclusive jurisdiction of the New Zealand courts with respect to any legal proceedings seeking to reverse the effect of a Determination requiring the suspension, cancellation, transfer or other amendment to a Domain Name registration, and agree that any such legal proceedings will be governed by New Zealand law; 
3. agree that their claims and remedies concerning the registration of the Domain Name, the dispute, or the dispute's resolution is solely against the Respondent;
4. are not making the Claim in bad faith, including that it is not for a dominant purpose other than resolving the issue of who the proper Domain Name Holder of a Domain Name is;
5. agree to comply with the Scheme Rules and be bound by any resulting Determination, subject to any rights of review or Appeal; 
6. acknowledge that if the Expert orders a transfer of the Domain Name to them or at their request:
   1. they will need to select an Authorised .nz Registrar to provide them with the necessary .nz registry and other services in respect of domain name, and they will advise Domain Name Commission (DNC) of their decision;
   2. that pending their selection of an Authorised .nz Registrar, the existing .nz Registrar of the Domain Names will continue to be the registrar of the Domain Names, and they will be deemed to have accepted that registrar’s existing terms; and
7. declare, to the best of their knowledge, the information contained in or attached to the Claim Form or otherwise comprising the Claim is true and complete in all
