Please use this application form if you wish to apply for NZDRC’s special fixed fee arbitration service for disputes as to payment obligations under commercial leases arising as a result of the COVID-19 lockdown.

Agreement to Arbitrate

To proceed under this special service, the parties will need to agree to arbitrate under the NZDRC COVID-19 Commercial Lease Arbitration Rules.

These Rules provide for a documents only arbitration procedure and are specifically designed to result in an Award being made which finally determines all substantive issues in dispute within 45 working days or earlier if the parties agree.

The fee which will apply to this service starts from $3,000.00 (including GST), depending on the amount in dispute. Please contact the Registrar at registrar@www.nzdrc.co.nz to confirm the fees for your dispute.

Once you have completed the agreement to arbitrate, please return to complete this application form.
